History:

Since 1995, Rep. Shadegg has continued to introduce this legislation in the House. The bill has enjoyed bi-partisan support, at times garnering more than 100 co-sponsors, but it has never made it out of committee.

In the 111th Congress, H.R. 450 has been languishing in the House Judiciary Subcommittee on the Constitution, Civil Rights, and Civil Liberties since February 9, 2009.

The Enumerated Powers Act requires each Act of Congress to contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. It also declares that failure to comply with this requirement would give rise to a point of order in either chamber of Congress.

S. 1319 is the Senate equivalent of the Enumerated Powers Act and it was introduced in the 111th Congress by Sen. Tom Coburn (R-OK). It has 22 Republican co-sponsors and has been referred to the Senate Rules and Administration Committee.
